Terms & Conditions, Booking, and Liability Waiver
Important Billing Notice
At Bay Padel, all bookings are charged per player, not per court. Each participant is responsible for their share of the court fee based on the club’s hourly rate and their membership type.
1. Court Booking Cancellation & No-Show Policy
This policy applies to both late cancellations and no-shows.
1.1. Cancellation windows:
- Unlimited Members (including but not limited to Unlimited, Shareholders and Ambassadors): must cancel at least 6 hours before the scheduled time.
- Standard Members (including but not limited to Founding Members, Students, Google Members, and Regular Members): must cancel at least 12 hours before the scheduled time.
- Non-members and guests must cancel at least 24 hours before the scheduled time.
1.2. Charges:
If a booking is canceled after the allowed window—or if players do not show up—the club will charge the full cost of the court (based on four (4) players in peak hours or two (2) in non-peak hours).
If more than the minimum number of players were listed in the booking (e.g., four players during non-peak hours), the total cost will still be split among all players who were originally added to the booking, regardless of how many show up.
The total amount will be distributed per player, according to their membership type:
FOR PADEL:
- Unlimited Members (including but not limited to Unlimited, Shareholders and Ambassadors) will be charged the Standard Member hourly rate for their share of the court, to their card on file.
- Standard Members (including but not limited to Founding Members, Students, Google Members, and Regular Members) will be charged their standard hourly rate, to their card on file.
- Non-members or guests will be charged the non-member rate for their share. If they do not have a card on file, the person who made the booking will be responsible for covering their portion.
FOR PICKLEBALL:
- All participants who cancel late or fail to show up will be charged the Non-member hourly rate, regardless of their membership type.
- If the Non-member rate was already paid in advance, no additional charge will be made.
The person who made the booking is ultimately responsible for ensuring the full cost of the court is covered.
1.3. Substitutes:
No fee will be charged for any player who finds a substitute before the start of the booking.
2. Booking Requirements
2.1. Each player is charged individually according to the club’s hourly rate.
2.2. For PADEL bookings during peak hours, a minimum of four (4) players must be added at the time of booking. If you’re unsure who will be playing, you may add placeholders as guests. However, each player is responsible for their share of the booking. If only two players show up, the remaining two spots will still be charged, and the person who made the booking will be responsible for the full amount.
2.3. For PADEL bookings during non-peak hours, a minimum of two (2) players is required, unless the booking is specifically for use of the ball machine.
2.4. For PICKLEBALL bookings during peak hours, a minimum of two (2) players is required. If fewer than two players show up, the full cost of the booking will still apply, and the person who made the booking will be responsible for the total amount.
IMPORTANT: Even though the minimum requirement is two players, in the event of a late cancellation or no-show, the full court cost will be charged as if four (4) players had been booked, in accordance with Bay Padel’s cancellation and no-show policy.
2.5. Peak hours are defined as:
- After 6:00 PM on weekdays
- All day on Saturdays and Sundays
Non-peak hours are all other times.
3. Payment Requirements
3.1. At least one player’s portion of the court fee must be paid at the time of booking.
3.2. Full payment must be completed before check-in.
3.3. If the court fee is not fully paid before the scheduled time, Bay Padel reserves the right to automatically charge the booking user the remaining balance.
4. Booking Terms
4.1. Advance Booking
Courts may be reserved in advance by both members and non-members through Bay Padel’s booking platform. The allowed booking window varies depending on membership type.
The booking windows are:
- Unlimited Members: up to 45 days in advance
- Standard Members: up to 30 days in advance
- Non-members and guests: up to 15 days in advance
Bay Padel reserves the right to adjust these windows.
4.2. Weather-Related Cancellations
For outdoor courts, Bay Padel reserves the right to cancel and refund reservations due to rain or adverse weather conditions up to one (1) hour before the scheduled time.
4.3. Overtime Charges
Overtime refers to court use that extends beyond the reserved time. It will be charged at the standard hourly rate in 15-minute increments. Charges will be split among all players with cards on file. If not all players have a card on file, the amount will be divided among those who do.
4.4. Ball Machine Usage
Ball machines may only be booked during non-peak hours, as defined by each Bay Padel Club’s local schedule.
4.5. Multiple Future Bookings
Players may hold up to four (4) active future bookings per club during peak hours at the same time.
This limitation applies only to peak hours. There is no limit on the number of active future bookings during non-peak hours.
To book an additional peak-hour reservation at that club, a player must first use or cancel one of their existing peak-hour reservations so that the total number of active future peak-hour bookings at that club returns to four (4) or fewer.
5. Liability Waiver
5.1. Assumption of Risk
By booking a court at Bay Padel, you acknowledge that padel and pickleball, as well as other activities available at the facility—including but not limited to ping pong, cornhole, pool table, and bouncy house—carry inherent risks. These risks include but are not limited to slips, falls, collisions, and equipment-related injuries. You voluntarily assume these risks and release Bay Padel from liability.
If the participant is a minor (under 18 years of age), their parent or legal guardian acknowledges these risks on their behalf and accepts full responsibility for their participation. The parent or legal guardian agrees to all terms of this waiver and releases Bay Padel from any liability related to the minor’s participation.
5.2. Safety Guidelines
You agree to follow all safety rules set by Bay Padel. Non-compliance may result in the termination of your reservation and restricted future access to the facility.
5.3. Injury and Damage Disclaimer
Bay Padel is not liable for injuries, accidents, or property damage occurring during your time at the facility. By booking, you waive any claims against Bay Padel, its employees, and affiliates.
Note: First aid assistance may be available but does not imply liability.
6. Indemnification
You agree to indemnify and hold Bay Padel harmless from any claims, costs, or damages, including legal fees, arising from:
- Your use of the facility.
- Violation of these terms.
- Disputes with other users.
7. Policy Updates
Bay Padel reserves the right to amend these terms and conditions at any time. Changes will take effect immediately upon posting on Bay Padel’s website or app. It is your responsibility to review updates periodically.
8. Photo and Video Consent
8.1. Use of Likeness
By entering Bay Padel facilities or participating in any activities, you grant Bay Padel the right to photograph, record, or otherwise capture your image, likeness, and/or voice during your visit.
8.2. Purpose and Scope
These photos or videos may be used for promotional, marketing, or informational purposes, including but not limited to Bay Padel’s social media channels, website, and other digital or print materials. No compensation will be provided for such use.
8.3. Opt-Out
If you do not wish to appear in photos or videos, you must notify staff upon arrival. While we will make reasonable efforts to accommodate such requests, full exclusion from all media cannot be guaranteed in public areas.
9. Acknowledgment and Agreement
By booking a court at Bay Padel, you confirm that:
- You have read, understood, and agreed to these terms and the liability waiver.
- You are of legal age or have the capacity to enter into this agreement.
